Terms of Service
Effective Last updated
These Terms of Service are an agreement between you and [legal entity name] (“Publisher”, “we”, “us”). They cover access to the service, an account you may create, the notes and flashcards you add, and the material the service generates.
Publisher lets you create flashcards, upload notes, paste text, generate flashcards with AI, store study material, and track learning progress. Please read these terms and the Privacy Policy before you use the service. If you do not agree, do not use Publisher.
Text in square brackets is a placeholder for a fact or a legal detail that still needs review. Replace it before relying on these terms. This page is not legal advice.
Acceptance of terms
#By visiting Publisher, creating an account, uploading or pasting content, generating flashcards, or otherwise using the service, you agree to these terms. If you use the service for an organization, you confirm that you have authority to bind that organization, and “you” includes that organization.
[Minimum age: state who may accept these terms. Align it with the age rule in the Privacy Policy. A person who is not old enough to agree should not use the service.]
User accounts
#Some features, including saving study material to an account and keeping progress across devices, require an account. You agree to provide accurate account information and to keep it up to date.
You are responsible for activity on your account and for keeping your credentials confidential. Contact [contact email] if you believe someone else is using your account. We may refuse a registration, or require a credential reset, where we need to for security or to enforce these terms.
[Account security: align this section with the sign-in method that ships, including what you must protect and what we store.]
Acceptable use
#Publisher is for personal and educational study. You may upload notes, paste text, create and edit flashcards, generate flashcards, save them, and review your progress, as long as you do so lawfully and within these terms.
You are responsible for the material you submit and for how you use what the service returns. The next sections describe ownership, generated content, and conduct that is not allowed.
User content ownership
#You keep the rights you already have in the notes, text, and flashcards you submit (“your content”). Publisher does not claim ownership of your content.
You grant Publisher a worldwide, non-exclusive license to host, store, reproduce, and process your content only as needed to operate and secure the service for you. That includes showing saved material back to you and sending text you ask us to turn into flashcards to the AI provider described in the Privacy Policy. The license lasts while the content is stored with us, and ends when it is deleted, except where a copy has to be kept for a limited time for security, backup, or a legal obligation.
[License scope: if study material can be shared with other users, or if content may be used to improve models, say so here. This draft does not grant either of those rights.]
You confirm that you have the rights needed to submit your content and to give this license, and that doing so does not break the law or someone else’s rights.
AI-generated content
#Flashcards and other text produced by the generator are created by a third-party AI model from material you supply. Generated content may be inaccurate, incomplete, outdated, or similar to material that exists elsewhere.
Publisher does not warrant that generated flashcards are correct, original, or fit for a particular course, exam, or purpose. AI output is not professional advice, and it is not a substitute for the source you were studying. Review it before you rely on it.
You are responsible for how you use generated content, including whether you had the right to submit the source material. We may refuse or limit a generation request that appears to misuse the feature.
Intellectual property
#The Publisher name, logo, website, software, and the design of the product are owned by [legal entity name] or its licensors. These terms give you a limited right to use the service while you follow them. They do not give you ownership of the product.
You may not copy the product, mirror the site, or use our name or logo in a way that suggests we endorse you, except where the law allows. If you send us feedback, we may use it to improve Publisher without an obligation to pay you or to implement it. [Confirm the feedback sentence with counsel before publication.]
Prohibited activities
#You may not, and you may not help anyone else to:
- Break the law, or violate someone else’s privacy, intellectual property, or other rights.
- Submit content you do not have the right to use.
- Attempt to access an account or data that is not yours, or bypass a limit or protection on the service.
- Interfere with the service, including by overloading it or by submitting malicious code.
- Use the AI features to generate scams, spam, or abusive material, or present AI output as professional advice.
- Misrepresent who you are, or resell or rebrand the service as your own product without written permission.
The list is illustrative. We may remove content or suspend access when we reasonably believe these terms have been broken.
Service availability
#Publisher is provided as available. We may add, change, or remove features, set limits on generation or storage, and pause the service for maintenance, security, or operations.
We do not promise that the service will be uninterrupted, that saved material will always be available, or that a particular feature will remain. Keep your own copy of anything you cannot afford to lose.
Limitation of liability
#The service is provided “as is” and “as available.” To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and any warranty that the service will be uninterrupted or error-free. We do not guarantee a grade, a score, or that you will remember what you review.
To the extent the law allows, Publisher and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost study time, arising out of your use of the service or your reliance on flashcards, whether or not we knew those damages were possible.
[Liability cap: state any cap on damages, for example fees paid over a defined period, only after counsel confirms the amount and that a cap is allowed. This draft does not set a number, and it does not say that liability is zero when the service is free.]
Some places do not allow certain disclaimers or limits. In those places, they apply only as far as the law allows. Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, or a consumer right that cannot be waived. Do not read this section as a statement that a particular claim is barred.
Termination
#You may stop using Publisher at any time. You may ask us to close your account by emailing [contact email]. [The closure process, and what happens to stored study material, should match the Privacy Policy.]
We may suspend or close your account, or stop providing the service to you, if you break these terms, if we need to for security, or if we discontinue Publisher. Where it is reasonable and the law allows, we will tell you. We may remove content that violates these terms.
Sections that by their nature should continue after access ends — including your content license for copies we must retain, the AI disclaimer, intellectual property, limitation of liability, and governing law — remain in effect.
Privacy
#The Privacy Policy describes how personal information is handled. It is part of these terms. If these terms and the Privacy Policy conflict on a question of personal information, the Privacy Policy controls.
Changes to these terms
#We may update these terms. When we do, we will change the “Last updated” date at the top of this page. The version on this page is the current version.
[Change notice: state how a material change will be communicated before continued use is treated as acceptance.]
If you continue to use Publisher after an update, you agree to the updated terms to the extent the law gives continued use that effect. If you do not agree, stop using the service and ask us to close your account.
Governing law
#[Governing law and venue: these terms are intended to be governed by the laws of [jurisdiction], and disputes are intended to be heard in [courts or other forum]. Choose both with counsel. Do not publish a country, state, or dispute process until that review is done. This placeholder is not a choice of law.]
If a provision cannot be enforced, the rest of these terms still applies, to the extent the law allows. Nothing in this section limits a right that consumer law says cannot be waived.

#Questions about these terms can be sent to [contact email].
